This license applies only to content voluntarily submitted through open communication features; it does not apply to the personal or health information you provide as part of scheduling, registration, or treatment, which is instead governed by our Privacy Policy.

 

3. Indemnification

You agree to indemnify and hold harmless Peak Therapy, its affiliates, and their owners, directors, officers, employees, and agents from any losses, claims, damages, or costs, including reasonable attorneys' fees, arising from your violation of this Agreement or misuse of your account. We may take over the exclusive defense of any claim subject to indemnification, and you agree to cooperate with that defense.

 

4. No Warranty

Our website and Resources are provided "as is" and "as available." We do not guarantee that:

• The Resources will meet your specific needs;

• Access will be uninterrupted, timely, or error-free;

• Information provided through the site will always be accurate or complete; or

• Any technical issues will be corrected.

8. Governing Law

Peak Therapy operates this website from Mississippi. If you access the site from outside Mississippi, you do so on your own initiative and are responsible for compliance with local law. This Agreement is governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, and excluding the United Nations Convention on Contracts for the International Sale of Goods. Any dispute arising from this Agreement will be brought exclusively in the state or federal courts located in Mississippi, and you consent to personal jurisdiction and venue in those courts.

 

9. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, PEAK THERAPY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

 

10. Not a Substitute for Professional Care

The content on this website, including text, images, and any exercise, stretching, or treatment information, is provided for general informational purposes only. It is not intended as a substitute for individualized evaluation, diagnosis, or treatment from a licensed physical therapist, occupational therapist, chiropractor, physician, or other qualified health care provider.

11. Scheduling, Referrals, and Insurance

Coverage, authorization, and out-of-pocket costs are determined by your insurance carrier, and you remain responsible for charges not covered by your plan.
